1. Acceptance of Terms

These Terms of Service ("Terms", "Agreement") form a legally binding contract between you ("User", "you") and PF Games ("PF Games", "we", "us") governing your use of the Zooyale mobile game and related services, including this website and the tester application program (the "Service").

By downloading, installing, or using Zooyale — or by submitting an application through this website — you agree to these Terms. If you do not agree, do not use the Service.

These Terms also serve as the End User License Agreement (EULA) for the Service.

3. Eligibility

3.1. Minimum Age

You must be at least 13 years old to use the Service (or the higher minimum age set by your country, e.g., 16 in some EU member states).
If you are between the minimum age and the age of majority in your jurisdiction (typically 18), you may only use the Service with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
We may restrict certain features (voice chat, social interaction, friend requests, in-app purchases) for users under the age of majority.

3.2. Legal Capacity

You must have the legal capacity to enter into a binding contract in your jurisdiction.

3.3. Geographic Restrictions

The Service is not available in all regions. You are responsible for complying with the laws of your jurisdiction.

4. Account

4.1. Account Creation

You must provide accurate and current information.
One account per person; multiple accounts are prohibited unless expressly allowed.
You may not transfer, sell, lease, or share your account.

4.2. Account Security

You are responsible for safeguarding your credentials.
You are responsible for all activities under your account.
Notify us immediately of any unauthorized access at info@pfgames.io.

4.3. Third-Party Sign-In

The Service supports optional account linking with Apple Game Center (iOS) and Google Play Games (Android). When you choose to link, the respective platform's terms also apply. Linking is optional; the default sign-in method is anonymous via Unity Authentication. Facebook / Meta sign-in is not supported.

4.4. Account Linking, Switching and Conflicts

Linking your anonymous account to a provider preserves your in-game progress.
If the provider you choose is already linked to a different Unity Authentication player, the Service will switch to that existing account and your current anonymous progress on this device will be lost. You will be asked to confirm before this happens.
You may unlink at any time from Settings → Account; doing so reverts to an anonymous-only state on this device.

4.5. Account Deletion

You may permanently delete your account at any time from Settings → Account → Delete Account, or by emailing info@pfgames.io. See Privacy Policy Section 9 for the full effect of deletion. Deletion is irreversible — virtual items, currency and progress are permanently forfeited.

5. License Grant

Subject to your compliance with these Terms, PF Games grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service on a device you own or control for personal, non-commercial entertainment purposes only.

All rights not expressly granted are reserved by PF Games and its licensors.

6. Prohibited Conduct

You shall not, and shall not allow others to:

6.1. Cheating and Technical Abuse

Use cheats, bots, automation, macros, modifications, hacks, or unauthorized third-party software
Reverse-engineer, decompile, disassemble, or modify the Service except as permitted by law
Attempt to gain unauthorized access to servers, accounts, or data
Conduct DDoS attacks, exploit bugs, or manipulate network traffic
Tamper with the in-game economy
Use unauthorized emulators or simulators that gain competitive advantage

6.2. Account Integrity

Buy, sell, trade, gift, or rent accounts or in-game items outside of permitted Service mechanisms
Engage in Real-Money Trading (RMT) of virtual items or currency
Provide or use "boosting" services (playing on or for another's account)
Impersonate PF Games staff, moderators, or other users

6.3. Community Conduct

Harass, threaten, bully, stalk, dox, or discriminate against other users — including over in-game voice chat (Vivox lobby, team, and proximity channels)
Engage in hate speech, racism, sexism, or any discriminatory behavior
Share content that is sexually explicit, obscene, violent, or otherwise inappropriate
Engage in any content or behavior that sexualizes, exploits, or harms minors — zero tolerance; reports made to law enforcement
Use the voice chat to broadcast pre-recorded media, advertisements, or content you do not have rights to
Spam, advertise, or send unsolicited commercial messages
Disclose other users' personal information

6.4. Legal Violations

Use the Service for any illegal purpose
Infringe intellectual property, privacy, or other rights
Engage in money laundering or fraud
Violate export control laws or sanctions

6.5. Competitive Integrity

Intentionally lose matches ("throwing")
Go AFK (away from keyboard) repeatedly
Engage in match-fixing
Deliberately disrupt teammates ("griefing")

Violations may result in warnings, temporary suspension, permanent ban, removal of virtual items, and/or legal action.

7. Virtual Items and Virtual Currency

7.1. No Ownership

Virtual items, currency, characters, cosmetics, and other digital content within the Service:

Have no real-world monetary value
Are not your property; you receive only a limited, personal, non-transferable license to use them within the Service
Cannot be redeemed for cash or anything of monetary value outside the Service
May be modified, removed, or terminated at PF Games' discretion

7.2. No Transfer

You may not sell, trade, or transfer virtual items or currency to other users or third parties outside of permitted Service features.

7.3. Revocation

PF Games may revoke virtual items in cases of fraud, cheating, chargeback, refund, or other Terms violations.

7.4. No Loot Boxes / Randomized Paid Content

The Service does not offer loot boxes, gacha mechanics, or any paid randomized content. All paid virtual items are sold at a known price for a known item. If this changes in the future, these Terms and the Privacy Policy will be updated with at least 15 days' advance notice and any new mechanic will comply with applicable laws and platform requirements.

8. Purchases and Payments

8.1. Payment Processing

All purchases are processed exclusively through Apple App Store or Google Play Store. PF Games does not receive your payment card or financial account information directly.

8.2. Prices and Currency

Prices are displayed in your local currency, inclusive of applicable taxes. We may change prices at any time without prior notice.

8.3. Purchase Confirmation

All purchases are final once confirmed. Virtual items are delivered to your account immediately upon confirmation.

8.4. Subscriptions (if applicable)

The Service does not currently offer subscriptions. If we introduce subscriptions in the future:

The subscription period, renewal terms, and price will be disclosed at purchase
Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
Manage and cancel subscriptions through your platform account settings (Apple ID / Google Play)
Refunds are handled by the platform, not PF Games

8.5. Currencies and Virtual Items

The Service uses two virtual currencies: COIN and GEM. Some items may also have a one-off price.
Virtual currency may be earned in-game or purchased through the Apple App Store / Google Play Store.
All virtual currency and items are subject to Section 7 — they have no real-world value, are non-transferable, and may be modified or removed.

9. Refund Policy

9.1. Platform Policy

Refund requests must be directed to the platform where the purchase was made:

Google Play Store: Through your Google Play account

9.2. EU/UK Consumer Rights

For consumers in the EU/UK, the statutory 14-day right of withdrawal does not apply to digital content once delivery has begun with your express consent and acknowledgment that the right of withdrawal is thereby lost (per EU Directive 2011/83/EU). By purchasing virtual items, you expressly consent to immediate delivery and acknowledge loss of withdrawal rights.

9.3. Turkish Consumer Rights

Per Turkish Consumer Protection Law No. 6502 and the Distance Sales Regulation Art. 15/1-ğ, the right of withdrawal does not apply to digital content delivered electronically once delivery has begun with the consumer's prior consent.

9.4. Discretionary Refunds

In exceptional cases (technical errors, duplicate charges), PF Games may offer refunds at its sole discretion.

10. Intellectual Property

10.1. PF Games' Rights

The Service, including all graphics, sound, music, code, character designs, maps, story elements, trademarks, and logos, is owned by PF Games and its licensors.
The Service is protected by copyright, trademark, and other intellectual property laws.

10.2. Restrictions

You may not:

Copy, modify, distribute, sell, or create derivative works of the Service
Use the Service or its content for commercial purposes
Use PF Games trademarks without written permission

10.3. Fan Content Policy

Personal, non-commercial gameplay videos, screenshots, streams, and fan art are permitted, provided:

You credit PF Games as the source
You do not display cheats, exploits, or illegal content
You do not imply official endorsement or affiliation
You comply with our Fan Content Guidelines

10.4. DMCA / Copyright Complaints

To report copyright infringement, contact our DMCA agent at info@pfgames.io with the information required under 17 U.S.C. § 512(c)(3).

11. User-Generated Content (UGC)

11.1. License to PF Games

By submitting content — including usernames, custom text submitted through support / report flows, tester application form answers, and any voice transmissions over Unity Vivox — you grant PF Games a worldwide, royalty-free, irrevocable, perpetual, transferable, sublicensable license to use, host, reproduce, modify, display, distribute, and create derivative works of such content in connection with the Service.

11.2. Voice Chat

Real-time voice transmissions are transported by Unity Vivox and are not retained by PF Games after transmission. However, if you submit a moderation report containing a voice recording or transcript, PF Games may retain that submission for the moderation period stated in the Privacy Policy.

11.3. Content Standards

Your UGC must comply with Section 6 (Prohibited Conduct) and applicable law. The Service does not offer a free-text in-game chat feature; the only direct player-to-player communication is voice chat.

11.4. Moderation

We may remove, edit, or block any UGC and may temporarily or permanently restrict your access to voice chat at our discretion, with or without notice.

11.5. Responsibility

You are solely responsible for your UGC. PF Games is not liable for UGC posted by users.

12. Account Suspension and Termination

12.1. By PF Games

We may suspend or terminate your account, with or without notice, for:

Breach of these Terms
Illegal conduct
Cheating or fraud
Threats to Service security or other users
Inactivity (after extended periods, with notice)

12.2. By You

You may delete your account at any time (see Privacy Policy Section 9 for the procedure). Upon deletion:

Virtual items, currency, and progress are permanently forfeited without refund
Data is processed according to the Privacy Policy

12.3. Effect of Termination

Upon termination, your license to use the Service ends immediately. Provisions of these Terms that by nature should survive termination (e.g., IP, liability, dispute resolution) shall survive.

13. Tester Program

Submitting a tester application through this website does not guarantee acceptance. Selection is at our sole discretion. If selected, you may be asked to agree to a separate Playtest Agreement and Non-Disclosure Agreement (NDA) before receiving access to confidential builds. You agree not to submit false, abusive, or automated applications.

14. Changes to the Service

PF Games may, at any time and without prior notice:

Modify, update, or discontinue features of the Service (including voice chat, friend list, leaderboards, push notifications)
Add or remove content, characters, mutant transformations, maps, modes
Adjust game balance, mechanics, or economy (COIN / GEM values, drop rates, matchmaking parameters)
Discontinue the Service in whole or in part

If we discontinue the Service entirely, we will provide reasonable advance notice when feasible.

14.1. Required Updates

The Service performs a version gate check at launch. If a mandatory update is required (security, compliance, or compatibility), you may be unable to continue playing until the latest version is installed. Soft prompts may also be shown for non-mandatory updates.

15. Disclaimer of Warranties

To the maximum extent permitted by law:

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
We do not warrant that the Service will be uninterrupted, error-free, secure, or virus-free.
We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow exclusion of certain warranties; in such cases, exclusions apply only to the extent permitted by law.

16. Limitation of Liability

To the maximum extent permitted by law:

PF Games shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, goodwill, or virtual items.
Our total aggregate liability arising out of or in connection with these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the six (6) months preceding the claim, or (b) USD 100 (or local equivalent).

These limitations do not apply to:

Liability for gross negligence or willful misconduct
Liability that cannot be excluded under applicable law (e.g., consumer protection laws)

17. Indemnification

You agree to indemnify, defend, and hold harmless PF Games, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your breach of these Terms
Your violation of any law or third-party right
Your UGC
Activities under your account

18. Dispute Resolution

18.1. Informal Resolution

Before initiating formal proceedings, contact us at info@pfgames.io. Most disputes can be resolved within 30 days.

18.2. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law principles. Mandatory consumer protection laws of your country of residence remain applicable.

18.3. Jurisdiction

For non-consumer disputes, the courts of Ankara, Türkiye shall have exclusive jurisdiction.

For consumer disputes:

EU/UK consumers may bring actions in their country of residence under local consumer protection laws.
Turkish consumers may apply to Tüketici Hakem Heyetleri (Consumer Arbitration Boards) and Consumer Courts per Law No. 6502.
US users: see Section 18.4 below.

18.4. Class Action Waiver (where enforceable)

In jurisdictions where enforceable (notably the United States), you and PF Games agree that any disputes shall be resolved on an individual basis, and not as a class, consolidated, or representative action.

19. Force Majeure

PF Games shall not be liable for failures or delays caused by events beyond reasonable control, including natural disasters, war, pandemics, internet outages, cyber-attacks, government actions, or labor disputes.

20. Apple App Store Additional Terms

If you obtained the Service through the Apple App Store, the following additional terms apply:

a) Acknowledgment: These Terms are between you and PF Games, not Apple. Apple is not responsible for the Service or its content.

b) Scope of License: The license is limited to use on Apple-branded products you own or control, as permitted by the Apple Media Services Terms and Conditions Usage Rules.

c) Maintenance and Support: PF Games (not Apple) is solely responsible for providing maintenance and support services for the Service.

d) Warranty: PF Games is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service.

e) Product Claims: PF Games (not Apple) is responsible for addressing any claims relating to the Service, including but not limited to: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

f) Intellectual Property Rights: In the event of any third-party claim that the Service or your use of the Service infringes that third party's intellectual property rights, PF Games (not Apple) will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

g) Legal Compliance: You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

h) Third-Party Beneficiary: You and PF Games acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

21. Google Play Additional Terms

If you obtained the Service through Google Play, the Google Play Terms of Service also apply. In the event of conflict, the Google Play Terms govern only with respect to the platform-related provisions.

22. General Provisions

22.1. Entire Agreement

These Terms, together with the Privacy Policy and any region-specific notices (e.g., KVKK Notice for Türkiye), constitute the entire agreement between you and PF Games.

22.2. Severability

If any provision is held invalid or unenforceable, the remaining provisions shall continue in effect.

22.3. No Waiver

Failure to enforce any right does not constitute a waiver of that right.

22.4. Assignment

You may not assign your rights under these Terms. PF Games may assign these Terms freely.

22.5. Notices

We may provide notices through the Service, email, or our website. Notices to us must be sent to info@pfgames.io.

22.6. Language

The English version of these Terms is the master version. Translations are provided for convenience. In case of inconsistency, the English version prevails, except where local law requires otherwise.

23. Changes to These Terms

We may update these Terms. Material changes will be announced via:

In-game notification
Email to your registered address
Website notice

For material changes, we will provide at least 15 days' advance notice. Continued use of the Service after the effective date constitutes acceptance. If you do not agree, delete your account.
